Ottawa County Public Records and FOIA
The Michigan Freedom of Information Act at MCL 15.231 is the basic state public records law. It covers county departments, agencies, and public bodies. Ottawa County uses an online FOIA Tracker at app.miottawa.org/FOIA for online FOIA requests. The county page directs users to check existing online resources first, including well and septic records, vital records, and MiCOURT court records.
Court case records are not standard FOIA records. They are governed by MCR 8.119, with MCR 1.109 covering protected personal identifying information. For court files, the path is MiCOURT or direct contact with the office of record. Mixing FOIA with court case requests slows everything down because the wrong office must reroute the request.
The county's online intake is shown on the FOIA Tracker public page.
The same page shows the policy and procedure documents the county publishes alongside the request workflow.
Types of Ottawa County Public Records
The county menu groups Court Services, Payments, Permits and Licensing, and Public Records together. The Public Records list directly links accident reports, birth, death, and marriage records, deeds search, FOIA requests, inmate lookup, minutes and agendas, property mapping, property search, vital records search, and well and septic records. The right tool depends on the record family. Sheriff and law enforcement records follow FOIA but may have exemptions for active investigations, security, and protected privacy.
- Court case records - MiCOURT and the office of record.
- Sheriff and jail records - the Ottawa County Sheriff, with FOIA Tracker for administrative files.
- Vital records - the Ottawa County Clerk Vital Records Division and the Vital Records portal.
- Property records - the Register of Deeds online deeds search.
- Property mapping and parcel data - county property mapping and property search tools.
- Accident reports - typically through the Sheriff or the local police agency that took the report.
- Well and septic records - the county environmental health office.
- Meeting minutes and agendas - the county clerk and board of commissioners.
How to File a FOIA Request in Ottawa County
FOIA requests are made through the county's online FOIA Tracker. First-time requesters must register a public account; returning users log in with email and password. The Tracker page links to the FOIA Fee Itemization Form, FOIA Procedures and Guidelines, and the county FOIA Policy. The steps below describe the standard request flow.
- Check whether the record is already available through a county online portal. The FOIA Tracker lists vital records, well and septic records, and MiCOURT as places to look first.
- Pick the right department. FOIA covers county executive records; court records use MiCOURT and the court clerk.
- Open the FOIA Tracker. Register a public account if this is your first request, or log in if you already have one.
- Describe the records sought with as much specificity as possible: dates, names, document types, departments.
- Submit the request and wait for the county's response. Michigan FOIA at MCL 15.235 sets a response deadline of five business days, with a possible 10-business-day extension.
- Pay the fee invoice if one is issued. Fees are itemized under MCL 15.234 and the county's FOIA Fee Itemization Form.
- Receive the records, a partial response with redactions, or a denial. Appeals or court actions follow MCL 15.235 if the request is denied.

Ottawa County FOIA Exemptions
Not every Ottawa County public record is released under FOIA. MCL 15.243 lists the standard exemptions: personal privacy, law enforcement interests, security plans, ongoing investigations, attorney work product, records protected by other statutes, and certain trade secrets. Juvenile records under MCL 712A.28, adoption records under MCL 710.67, and mental health records under MCL 330.1748 remain confidential regardless of FOIA.
Ottawa County Vital Records and Register of Deeds
Vital records (birth, death, marriage) are ordered through the Vital Records Division of the County Clerk. The online portal at app.miottawa.org/VitalRecords splits records by date range, charges $15 for the first certified copy and $6 for each additional copy on the same order, and mails completed orders within 5 business days. Birth records have eligibility limits under Michigan law and require qualifying relationship and ID.
Register of Deeds documents are searched online at the county's Deeds Search portal. Paper deed copies cost $1 per page plus a technology fee. The Register of Deeds accepts cash, check, or credit card for recording, with a 3% convenience fee on credit card recording payments. The Register does not accept fax or copy documents for recording; only originals work. Court documents must be certified by the court before recording. The County Clerk and Register pages cite MCL 600.916(1) in declining to give legal advice.
Ottawa County Court Case Records
Court records are not FOIA records in the same sense. They follow MCR 8.119 and the office of record. For court files, see court records, court dockets, arrest records, and traffic court records. For jail and inmate records, see inmate records and released inmates. For marriage, divorce, and probate, see marriage and divorce records and Probate Court.
Note: Always check whether the record is in a county online portal before filing a FOIA request, since the county directs users to existing online resources first.
